The ability to process huge data sets and derive conclusions and insights can be phenomenally powerful. It can also be really scary, particularly if you are insufficiently clear and honest about whose data you are processing and where you get it from. We can, of course, help you understand your legal position, but we think that doing big data successfully requires far more careful consideration than just that.

We have experience in advising on large-scale big data projects and data analytics, including highly-visible customer transparency campaigns and liaising with privacy rights groups.

Privacy by design

We can help you understand your legal obligations for data handling, including using other companies to process for you, as well as those processing offshore.

More fundamentally, we can help you to think through the impact that your activity is likely to have, and the areas in which concerns are likely to arise, to help you design a service which is commercially successful and privacy friendly. This involves more than an pre-ticked checkbox, or some words hidden in an agreement.

Regulatory engagement

Depending on what you are planning on doing, you might want to discuss your plans with the Information Commissioner's Office, or other regulator, before you go live, to get a sense of any likely concerns. We can help you plan your engagement strategy, and aim to pre-empt the kind of questions that they will have, to help you make the most of your time.

Contractual issues

If you are going to be engaging someone to process your customers' precious data on your behalf, you'll need to ensure that you have an appropriate data processing agreement, as part of your security strategy.

If you are processing on behalf of another data controller, you'll want to make sure that you have a clear view of your obligations, risks and liabilities. Getting expert legal advice early in the process can help reach an agreement which works for both parties.
